Our Philosophy

It is my experience in nearly 30 years of resolving disputes among individuals, companies, and organizations in business, law, government, and families, as a litigation attorney and a mediator, that the most important question is “What do you really want?” The most effective resolution is to move beyond “us vs. them” and forge a problem solving team among parties, counsel and experts to develop a resolution that is truly a win for all parties. We do this using innovative conflict resolution, communication, and problem solving processes.

The Win Win Model

In my experience conflict begins when (1) people, even well intentioned people, communicate poorly or (2) people cannot appreciate one another’s perspectives. “We all see the elephant from a different place.” Seldom is one person the sole cause; usually everyone involved has something to do with creating the circumstance. Choosing to shift the focus from “blame and judgment” to “What do we really want” is the beginning of a win win resolution.

To help the parties make this shift, we invite them to ask:

• Is it possible that they each might have contributed to the circumstance in some way by what they did or did not do?

• Is it possible that there is some opportunity in the circumstance for mutual benefit?

• Is it possible that the objectionable behavior of the “other” party is somehow a mirror of their own behavior?

The answers to these questions help people put the “conflict” behind them and focus on finding a resolution that works for all.
